ALLOCATION IS SOLELY OPEN TO USERS OF THE RELEVANT SCOPELY EXPLORE APPLICATION, RESIDENTS OF COUNTRIES WHERE THE RELEVANT SCOPELY EXPLORE APPLICATION HAS BEEN OFFICIALLY RELEASED AND WHERE NOT PROHIBITED BY LAW.
ENTRY CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.
1. BINDING AGREEMENT: In order to participate in the Allocation, You must agree to these Ticket Allocation Terms and Conditions (“Terms and Conditions”). Therefore, please read these Terms and Conditions prior to registration to ensure You understand and agree.
2. SPONSOR: The Allocation is operated by Scopely Explore (formerly known as Niantic, Inc.) (“Scopely Explore”), with offices at Pier One, Bay 3, San Francisco, CA 94111, USA.
3. HOW TO REGISTER: To enter the Allocation, you need to register for the event’s ticket allocation (the “Allocation”) through the relevant Scopely Explore application (the “Application”) during the specified registration time period. Event, registration, selection, purchasing and claiming details can be found in the Application.
4. TICKETS: This Allocation merely provides You with the opportunity to purchase or claim tickets to the event during a specified time and tickets will still need to be purchased or claimed by You in the Application separately at prevailing rates during specified times. Being selected in the Allocation does not guarantee tickets, the ability to purchase or claim tickets or that tickets will be available. Tickets are subject to availability and may sell or run out. Scopely Explore has no obligations or liability should You be unaware of your selection, unavailable during your purchase or claim window, or otherwise unable to purchase or claim tickets during the specified time period for any reason. All ticket purchases or claims will be required to comply with other specifications, rules, and guidelines as specific to the tickets and event. The approximate retail value of being selected in the Allocation is $0 USD. No transfer, substitution, or cash equivalent is allowed, except at Scopely Explore’s sole discretion.
5. SELECTION METHOD.
5.1 General. Scopely Explore is responsible for the collection, submission, and processing of registrations and the overall administration of the Allocation. The selection method applicable to each event will be specified in the Application or in communications provided by Scopely Explore prior to the start of the registration period. Scopely Explore may use either of the following selection methods:
(a) Random Selection. Registrants are selected at random from the eligible pool. The likelihood of selection depends on the number of eligible registrations received, the total number of tickets available for the event, and the total number of tickets purchased or claimed by previously selected registrants.
(b) Timestamp-Based Selection. Registrants are selected in order from earliest to latest registration timestamp. Registrants who complete registration earlier are selected before registrants who complete registration later. In the event that two or more registrations share an identical timestamp, the order among those registrations will be determined at random.
5.2 Waves. The Allocation may proceed through multiple waves of selection until all tickets have been purchased or claimed, all registrations have been processed, or Scopely Explore elects to conclude the Allocation. The number of registrants selected in each wave is determined by Scopely Explore based on remaining event capacity and applicable per-account purchase limits.
5.3 Purchase Window. Selected registrants will receive a time-limited window to purchase or claim tickets through the Application (“Purchase Window”). The selection notification or the Application will specify when the Purchase Window opens and closes. If a selected registrant does not complete purchase or claim within the Purchase Window, their selection will expire and the allocation may be offered to the next eligible registrant.
6. SCHEDULES: All scheduled actions including, but not limited to, entry and registration times, Allocation selection times, and ticket purchase or claim time windows will be processed approximately at the date and time specified. You acknowledge and accept that actual timing is at Scopely Explore’s sole discretion and may vary from the exact time specified. Registration timestamp accuracy depends on system availability and network conditions. Scopely Explore does not guarantee that timestamps will reflect the exact moment You initiated Your registration if system latency, network congestion, or other technical factors affect transmission.
7. NOTIFICATIONS: If you are selected, Scopely Explore may endeavor to notify you through the provided e-mail address and/or applicable App notifications. You agree Scopely Explore has no obligation to affirmatively notify You of Your selection and You agree to check your App during the Allocation and purchase or claim time periods for your Allocation status. If You are not selected in a given wave, You may be selected in a subsequent wave if capacity remains available. Scopely Explore is not obligated to notify You of non-selection.
8. GENERAL CONDITIONS: All federal, state, provincial and local laws and regulations apply. Scopely Explore reserves the right to disqualify any registrant from the Allocation if, in Scopely Explore’s sole discretion, it believes that the registrant has attempted to undermine the legitimate operation of the Allocation by cheating, deception, use of automated tools or scripts, registration through multiple accounts, or other unfair playing practices or annoys, abuses, threatens or harasses any other registrants or Scopely Explore.
9. INTERNET AND OTHER TECHNICAL ISSUES: Entry into the Allocation and subsequent purchasing or claiming of tickets following selection rely on access to the internet. Scopely Explore is not responsible for any malfunction or for any late, lost, damaged, misdirected, incomplete, undeliverable or destroyed entries due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or the App, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate.
10. RIGHT TO CANCEL, MODIFY OR DISQUALIFY: If for any reason the Allocation is not capable of running as Scopely Explore intended, including changes to or cancellation of the event itself, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Allocation, Scopely Explore reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Allocation and if terminated, Scopely Explore may elect to determine the potential selected entrants for the Allocation from among all eligible entrants received prior to action taken. Scopely Explore further reserves the right to disqualify any entrant who violates these Terms and Conditions or tampers with the submission process or any other part of the Allocation or App. Any attempt by an entrant to deliberately damage any website or the App, or undermine the legitimate operation of the Allocation may be a violation of criminal and civil laws and should such an attempt be made, Scopely Explore reserves the right to seek any and all remedies available from any such registrant to the fullest extent of the applicable law.
11. PRIVACY: You acknowledge and agree that Scopely Explore may collect, store, share and otherwise use any personally identifiable information provided to Scopely Explore throughout the Allocation including, but not limited to, account name and email address. Scopely Explore will use this information in accordance with its Privacy Policy located at https://explore.scopely.com/privacy, including without limitation for administering the Allocation. Your information may also be transferred to countries outside the country of Your residence, including the United States. Such other countries may not have privacy laws and regulations similar to, or deemed adequate by, those of the country of Your residence.
12. DISPUTES AND TERMS OF SERVICE: By registering to participate in the Allocation, You agree that all disputes between You and Scopely Explore of whatsoever kind or nature arising out of these Terms and Conditions, shall be subject to Scopely Explore’s standard Terms of Service available at https://explore.scopely.com/terms, which are hereby incorporated into these Terms and Conditions in their entirety by reference. You accept and agree to abide by the Terms of Service as a condition of participation.
